Most of the people we defend on assault charges were arrested or ticketed in the aftermath of a fight. We've advised people whose altercations took place in a bar, a nightclub, a stadium, a store, a subway station or on the street. We also represent people charged with domestic assault.
In many cases, at least where neither combatant is left dead or unconscious, the police will arrest everyone involved and sort out the equities of the situation back at the station. In our experience, the best defense will often be the other side of the story.
We work closely with clients and witnesses to develop the facts that will support your best available defense. In some situations, we can make a strong enough presentation of self-defense to achieve a dismissal of the case before it gets too far. More often, we'll show how provocation or unsuccessful attempts to disengage from the fight should factor into the charges or the disposition. Once in a while we can establish that the police arrested the wrong person through mistaken identity.
Where no deadly weapons were used or where no great bodily harm resulted, you'll usually have a chance for adjournment in contemplation of dismissal, or ACD. This puts the prosecution on hold and results in dismissal of the charge if you stay out of further trouble for a prescribed period.
